TERMS OF SERVICE

Responsible sending is a condition of using WHPSend.

These terms govern access to and use of WHPSend. By accessing the service, you agree to follow these terms and all applicable Web Host Pro account policies.

1. The service

WHPSend is a Web Host Pro application for organizing contacts, managing mailing lists, configuring approved SMTP profiles, preparing email campaigns, processing unsubscribe requests, reviewing list health, and recording delivery activity. Features, limits, and availability may change as the service develops.

2. Account eligibility and authority

You must be legally able to enter into these terms and authorized to act for the organization associated with the account. Information supplied during account creation and support interactions must be accurate and kept current.

You are responsible for activity performed through your account, protecting authentication credentials, limiting access to appropriate users, and notifying Web Host Pro promptly if you suspect unauthorized access.

3. Permission-based email requirement

You may send email only to recipients for whom you have a lawful basis to communicate and where the message is consistent with the permission, relationship, and expectations of the recipient. You must be able to explain how addresses were obtained and why each audience may be contacted.

You may not use purchased, rented, scraped, harvested, guessed, appended, or improperly shared email addresses. A publicly visible address is not, by itself, permission for bulk promotional email.

4. Message requirements

Every campaign must accurately identify the sender, use truthful subject and routing information, avoid deceptive claims, include information required by applicable law, and provide a clear unsubscribe method when required. You may not obscure the commercial nature or source of a message.

You must promptly honor opt-out requests and must not remove, defeat, conceal, or replace WHPSend's unsubscribe handling in a way that prevents recipients from leaving future campaigns.

5. Prohibited activity

You may not use WHPSend to send spam, phishing, malware, fraudulent offers, unlawful content, abusive or threatening material, deceptive impersonation, or content that infringes another person's rights. You may not attempt to bypass sending limits, suppressions, authentication, access controls, service safeguards, or provider policies.

Activity that creates excessive complaints, bounces, delivery failures, blocklist listings, infrastructure risk, or harm to Web Host Pro, its providers, or other customers may be investigated and restricted.

6. Contacts, campaigns, and credentials

You retain responsibility for the data and content you submit. You represent that you have the rights and permissions needed to store, process, and use that material through WHPSend.

SMTP credentials and API keys must be kept confidential. You may connect only accounts and servers you are authorized to use. You are responsible for provider fees, limits, requirements, reputation consequences, and delivery decisions associated with connected services.

Customer accounts must use approved external email accounts with authenticated SMTP access. Web Host Pro-hosted mailboxes and SMTP hosts on reserved Web Host Pro networks are unavailable to customer accounts. Small campaigns require at least three SMTP-enabled accounts, and larger campaigns should use additional accounts, preferably across different providers, while remaining within all provider limits.

7. Monitoring and enforcement

Web Host Pro may review service signals, logs, complaint information, failure patterns, and reports to maintain security, investigate abuse, and enforce these terms. Access may be limited, paused, or terminated when reasonably necessary to protect recipients, infrastructure, providers, or the service.

Serious or repeated violations may result in immediate suspension without prior notice. Where practical and appropriate, we may request information about list source, consent, campaign purpose, or remediation steps.

8. Availability and changes

WHPSend is provided on an as-available basis. Maintenance, provider interruptions, network events, security work, software changes, or circumstances outside reasonable control can affect availability or delivery. Email acceptance and inbox placement are not guaranteed.

Features may be added, changed, limited, or removed. Customers should retain appropriate copies of important contact and campaign information and should not treat WHPSend as the only record required for legal, regulatory, or business continuity purposes.

9. Intellectual property

WHPSend, its interface, software, branding, and documentation are owned by Web Host Pro or its licensors and are protected by applicable intellectual-property laws. These terms grant a limited right to use the service for its intended purpose; they do not transfer ownership.

You retain rights in your lawful content. You grant the limited permission needed for WHPSend and relevant service providers to process that content to operate, secure, support, and deliver the requested service.

10. Disclaimers and limitation

To the maximum extent permitted by law, WHPSend is provided without warranties of uninterrupted operation, error-free delivery, recipient engagement, inbox placement, or fitness for a particular campaign. You remain responsible for reviewing messages, audiences, legal requirements, and sending results.

To the maximum extent permitted by law, Web Host Pro will not be liable for indirect, incidental, special, consequential, or punitive damages, lost profits, lost opportunities, reputation effects, recipient claims, or provider actions arising from use of WHPSend. Any direct liability is subject to limitations contained in the applicable Web Host Pro service agreement.

11. Indemnity

You agree to be responsible for claims, losses, and reasonable costs arising from your audiences, campaigns, content, connected services, violation of these terms, or violation of another person's rights, to the extent permitted by law and the applicable Web Host Pro agreement.

12. Termination

You may stop using WHPSend at any time. Account access and stored information may be affected when the associated Web Host Pro service ends. Provisions that by their nature should survive, including responsibility for prior activity, intellectual property, disclaimers, limitations, and enforcement rights, continue after termination.

13. Changes and contact

These terms may be updated to reflect changes in WHPSend, provider requirements, law, or operational practices. The effective date will be revised when an updated version is published.
